What is Underinsured Motorist Coverage and how does it work?
When you are involved in a car accident and are not at-fault, the at-fault party is liable for bodily injuries caused by the accident. Often injuries are so significant in an accident that the at-fault party does not have enough insurance coverage (liability coverage) to pay for the damages. In these situations it is important to find out whether Underinsured Motorist Coverage (called "UIM") is available. UIM operates similar to Uninsured motorist coverage (called "UM"), but instead protects you when the at-fault party does not have enough insurance coverage to cover the damages in your claim...meaning the at-fault party is “underinsured”. In South Carolina, your insurance company is required to offer you the ability to purchase Underinsured Motorist Coverage but you are not required to make the purchase. Underinsured motorist coverage operates as another blanket of protection that may be available to protect you, your family, or loved ones for injuries sustained in a car wreck. Dealing with a car accident is a stressful time and the process can be complex. If you have questions about your injury accident and whether Underinsured Motorist Coverage may apply please feel free to contact our office at any time. The New York Times reports that "The Uber vehicle was in autonomous mode with a human safety driver at the wheel when it struck the woman". The New York Times also reports that Uber has currently suspended its testing of self-driving cars. This is reportedly the first death involving an a self-driving vehicle and a pedestrian. The news of this self-driving vehicle death further calls into question the safety of autonomous vehicles and laws surrounding the use and development of self-driving vehicles. While self-driving cars have long been thought to be safer alternative to human drivers, there are serious questions remaining about the programming of these vehicles and the laws surrounding use of these vehicles. If you have been involved in a car wreck with an uninsured at-fault driver don’t worry, you are not alone. Accidents where the at-fault driver is uninsured happen every day.
In fact, according to a 2017 study by the Insurance Research Council (IRC) approximately 1 in 8 drivers (or 13%) were uninsured in 2015. According to the IRC around 9.4% of drivers in South Carolina are uninsured. If you are hit by an uninsured motorist or involved in a hit-and-run accident, uninsured motorist coverage can help protect you. Uninsured motorist coverage can help cover the policyholder and riders in the vehicle if injuries occur during the accident. South Carolina law requires drivers to have Uninsured Motorist coverage at the minimum policy limits (25/50/25). Importantly, this means that if you have car insurance in South Carolina you at least have Uninsured Motorist Coverage of 25/50/25. As mentioned above, this Uninsured Motorist Coverage can be used to protect you and individuals in your covered vehicle if you were involved in an accident with an at-fault driver who does not have insurance. After an accident it is important to gather whether an insured has insurance. A police officer in South Carolina will complete a report of the accident, typically called a form (FR-10), which says who has what insurance company.
